Terms of service

<p>Welcome to Slope Masks. These terms apply to every visit to and purchase from slopemasks.com, a store operated by Moose Ventures Group LLC ("Slope Masks", "we", "us"). By using the site or placing an order you agree to these terms, our Shipping policy, our Refund policy and our Privacy policy, which together are the whole agreement between us.</p>
<p><strong>Please read section 14. It says disputes are settled by individual arbitration instead of in court, and that you can opt out within 30 days.</strong></p>
<h3>1. Who can order</h3>
<p>You must be 18 or older, or order with the consent of a parent or guardian. We ship to US addresses only.</p>
<h3>2. Orders, prices and promotions</h3>
<ul>
<li>Prices are in US dollars. Pack discounts are applied automatically in the cart.</li>
<li>Shipping is charged as shown at checkout. Sales tax, where it applies, is calculated at checkout.</li>
<li>Promotions and discount codes may end or change at any time and can't be combined unless we say so.</li>
<li>Your order is an offer to buy. We accept it when we ship it.</li>
</ul>
<h3>3. Our right to refuse or cancel</h3>
<p>We may refuse or cancel any order, including for suspected fraud, orders that look like resale, orders over a quantity limit, or a pricing, description or typing error. If we cancel after you have paid, we refund you in full.</p>
<h3>4. Shipping, delays and delivery</h3>
<p>Processing and delivery times are estimates, not guarantees. Holiday dates are recommendations. We are not liable for delays caused by carriers, customs, weather, holidays, natural events, strikes, outages or other events outside our reasonable control.</p>
<p>If we can't ship within our stated processing time, we follow the FTC Mail, Internet, or Telephone Order Merchandise Rule: we email you a revised date and the option to cancel for a full refund of unshipped items, as set out in our Shipping policy.</p>
<p>Responsibility for a parcel passes to you when the carrier marks it delivered to the address you gave us. You are responsible for entering a complete and correct address. Lost, stolen and damaged parcels are handled under our Refund policy.</p>
<h3>5. Returns, the 30-Day Promise and claims</h3>
<p>Returns, the 30-Day Promise and lost or damaged parcel claims are set out in our Refund policy, including time limits. The 30-Day Promise is a store policy, not a written warranty. We may ask for photos, allow one claim per order, decline claims that appear fraudulent or abusive, and limit repeat claims.</p>
<h3>6. Payment disputes</h3>
<p>If something goes wrong, please email us first; most problems are solved within a couple of days. If you open a chargeback, we will share order, tracking and message records with the payment provider. We may decline future orders from accounts linked to chargebacks we reasonably believe are fraudulent.</p>
<h3>7. Using our masks</h3>
<ul>
<li>Our masks are novelty items. They are not protective or safety equipment, do not replace a helmet or goggles, and are not rated for extreme cold.</li>
<li>Follow the care label.</li>
<li>Do not wear a mask where face coverings are prohibited, or to hide your identity for any unlawful purpose.</li>
<li>One size; fit varies from person to person. Colors and print may vary slightly from the photos on screen.</li>
<li>Ski goggles and helmets are not included.</li>
</ul>
<h3>8. Reviews, photos and other content you send</h3>
<p>If you send us or post a review, photo, video or comment about our products, you give us a free, nonexclusive, worldwide license to use, display and share it on our site and social media, with your first name or handle. You confirm it is yours to share and is honest.</p>
<p>We never remove a review because it is negative. We may remove reviews that are offensive, off topic, contain private information, or that we can't link to a real order. We do not pay or reward anyone for positive reviews.</p>
<h3>9. Our content</h3>
<p>Text, images, illustrations and designs on this site belong to Slope Masks or our licensors. Please do not copy or resell them without our written permission.</p>
<h3>10. Emails and electronic records</h3>
<p>You agree that we can send order confirmations, notices (including delay notices) and other messages by email, and that these count as written notice. Marketing messages are only sent if you sign up, and you can unsubscribe at any time.</p>
<h3>11. Disclaimer</h3>
<p>Except for what we promise in these terms and our policies, and to the extent permitted by law, our products and site are provided "as is", and we disclaim implied warranties, including merchantability and fitness for a particular purpose. Some states do not allow these limits, so they may not apply to you.</p>
<h3>12. Limit of liability</h3>
<p>To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim about an order is limited to the amount you paid for that order. This does not limit liability that cannot be limited by law.</p>
<h3>13. Your rights under the law</h3>
<p>Nothing in these terms limits any consumer right that cannot be waived under the law of your state or US federal law.</p>
<h3>14. Disputes and arbitration</h3>
<p><strong>Talk to us first.</strong> Email <a href="mailto:hello@slopemasks.com">hello@slopemasks.com</a> and give us 30 days to try to resolve it informally.</p>
<p><strong>Arbitration.</strong> If we can't, you and we agree to resolve any dispute about the site, your order or these terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. The arbitrator may award the same individual relief a court could.</p>
<p><strong>Small claims.</strong> Either of us may bring an individual claim in small claims court instead.</p>
<p><strong>No class actions.</strong> Claims may only be brought individually, not as a plaintiff or class member in any class, collective or representative action. If this class waiver is found unenforceable for a claim, that claim goes to court, not arbitration.</p>
<p><strong>Opt out.</strong> You can opt out of this section within 30 days of your first order by emailing <a href="mailto:hello@slopemasks.com">hello@slopemasks.com</a> with your name, email and order number and the words "arbitration opt out". Opting out does not affect the rest of these terms.</p>
<h3>15. Governing law</h3>
<p>These terms are governed by the laws of the State of Nevada and applicable US federal law, including the Federal Arbitration Act.</p>
<h3>16. Other terms</h3>
<ul>
<li>If any part of these terms is found unenforceable, the rest still applies.</li>
<li>We may update these terms. Changes apply only to orders placed after the update; the version posted when you place an order applies to that order.</li>
